Full text of the PIRATE Act (H.R.5709)

Many thanks to SWLing Post contributor, Ulis (K3LU), who shares a link to the full text of the H.R.5709 – PIRATE Act–a bill to “amend the Communications Act of 1934 to provide for enhanced penalties for pirate radio, and for other purposes.”

Here’s an excerpt from the preface of the bill:

SECTION 1. SHORT TITLE.

This Act may be cited as the “Preventing Illegal Radio Abuse Through Enforcement Act” or the “PIRATE Act”.

SEC. 2. PIRATE RADIO ENFORCEMENT ENHANCEMENTS.

Title V of the Communications Act of 1934 (47 U.S.C. 501 et seq.) is amended by adding at the end the following new section:

“SEC. 511. ENHANCED PENALTIES FOR PIRATE RADIO BROADCASTING; ENFORCEMENT SWEEPS; REPORTING.

“(a) Increased General Penalty.—Any person who willfully and knowingly does or causes or suffers to be done any pirate radio broadcasting shall be subject to a fine of not more than $2,000,000.

“(b) Violation Of This Act, Rules, Or Regulations.—Any person who willfully and knowingly violates this Act or any rule, regulation, restriction, or condition made or imposed by the Commission under authority of this Act, or any rule, regulation, restriction, or condition made or imposed by any international radio or wire communications treaty or convention, or regulations annexed thereto, to which the United States is or may hereafter become party, relating to pirate radio broadcasting shall, in addition to any other penalties provided by law, be subject to a fine of not more than $100,000 for each day during which such offense occurs, in accordance with the limit described in subsection (a).

“(c) Facilitation.—Any person who knowingly and intentionally facilitates pirate radio broadcasting shall be subject to a fine of not more than $2,000,000.

“(d) Annual Report.—Not later than one year after the date of enactment of the PIRATE Act, and annually thereafter, the Commission shall submit to the House Committee on Energy and Commerce and the Senate Committee on Commerce, Science, and Transportation a report summarizing the implementation of this section and associated enforcement activities for the previous fiscal year, which may include the efforts by the Commission to enlist the cooperation of Federal, State, and local law enforcement personnel (including United States Attorneys and the United States Marshals Service) for service of process, collection of fines or forfeitures, seizures of equipment, and enforcement of orders.

“(e) Enforcement Sweeps.—

“(1) ANNUAL SWEEPS.—Not less than once each year, the Commission shall assign appropriate enforcement personnel to focus specific and sustained attention on the elimination of pirate radio broadcasting within the top five radio markets identified as prevalent for such broadcasts. Such effort shall include identifying, locating, and taking enforcement actions designed to terminate such operations.

“(2) ADDITIONAL MONITORING.—Within six months after conducting the enforcement sweeps required by paragraph (1), the Commission shall conduct monitoring sweeps to ascertain whether the pirate radio broadcasting identified by enforcement sweeps is continuing to broadcast and whether additional pirate radio broadcasting is occurring.

“(3) NO EFFECT ON REMAINING ENFORCEMENT.—Notwithstanding paragraph (1), the Commission shall not decrease or diminish the regular enforcement efforts targeted to pirate radio broadcast stations for other times of the year.

“(f) State And Local Government Authority.—The Commission may not preempt any State or local law prohibiting pirate radio broadcasting.

“(g) Revision Of Commission Rules Required.—The Commission shall revise its rules to require that, absent good cause, in any case alleging a violation of subsection (a) or (b), the Commission shall proceed directly to issue a ‘Notice of Apparent Liability’ without first issuing a ‘Notice of Unlicensed Operations’.

“(h) Pirate Radio Broadcasting Database.—

“(1) IN GENERAL.—Not later than 90 days after the date of the enactment of this section, and semi-annually thereafter, the Commission shall publish a database in a clear and legible format of all licensed radio stations operating in the AM and FM bands. The database shall be easily accessible from the Commission home page through a direct link. The database shall include the following information:

“(A) Each licensed station, listed by the assigned frequency, channel number, or Commission call letters.

“(B) All entities that have received a Notice of Unlicensed Operation, Notice of Apparent Liability, or Forfeiture Order by the Commission.

“(2) CLEAR IDENTIFICATION.—The Commission shall clearly identify in the database—

“(A) each licensed station as a station licensed by the Commission; and

“(B) each entity described in paragraph (1)(B) as operating without a Commission license or authorization.

“(i) Definitions.—In this section:

“(1) PIRATE RADIO BROADCASTING.—The term ‘pirate radio broadcasting’ means the transmission of communications on spectrum frequencies between 535 to 1705 kHz or 87.7 to 108 MHz without a license issued by the Federal Communications Commission, but does not include unlicensed operations in compliance with part 15 of title 47, Code of Federal Regulations.

“(2) FACILITATES.—The term ‘facilitates’ means providing access to property (and improvements thereon) or providing physical goods or services, including providing housing, facilities, or financing, that directly aid pirate radio broadcasting.

“(3) KNOWINGLY AND INTENTIONALLY.—The term ‘knowingly and intentionally’ means the person was previously served by the Commission with a notice of unlicensed operations, notice of apparent liability, or citation for efforts to facilitate pirate radio broadcasting.”.

Mike’s review of the Sangean HDR-14 AM/FM HD Radio

Well, I did something I said i would not do, triggered by Amazon’s tendency to introduce impossibly low prices on things for a couple of days, I sprang for the HDR-14. I have used it side by side with its direct competitor (the Nicetex “SPARC” SHD-TX2) for a few nights and a couple of days. Interesting little device.

As has been pointed out by those that read the specs, it is barely larger than the CC Skywave overall. It is made of the same soft, shiny black plastic as the larger Sangean portables (it is alternately a fingerprint magnet or a scuff magnet) but has a much less solid feel. The swivel-out foot on the bottom is a welcome addition and works well.

I have not yet played with other features (memories, etc) except to note that somebody has finally gotten it right in that memory locations store the chosen FM multicast channel instead of just the frequency.

Performance is a mixed bag. This is NOT an HDR-16 crammed into a smaller cabinet; not surprising, really, considering the amount of real estate available for circuitry. Analog FM and HD capture are right up there with the the larger sets and similar to the SPARC. I am unable to reproduce the spurious FM image problem noted by a lone Amazon reviewer. Audio is “just OK” out of the speaker with a harsh emphasis on treble – the SPARC portable is MUCH better with its passive radiator – but just fine for headphones or an external speaker.

However, for AM, that reviewer was spot on. The noise floor on AM is a tad too high and the native sensitivity a tad too low; resulting in “just OK” useable sensitivity on the band especially compared to the SPARC. I had no trouble with AM-HD on the only two stations in NYC metro (WCBS and WINS); however, it was unable to even detect the HD carrier from known stations in nearby cities that I was able to get >50% on the HDR-16 and HDR-18. The selectivity is better than the SPARC due to the DSP active for bandwidth adjustment; witness that I was able to clearly separate stations in Connecticut (600) and Philadelphia (610) from the splatter of local powerhouses at 570 and 620. Unfortunately too, analog AM reception is plagued with DSP artifacts reminiscent of earlier Tecsun sets which can even manifest in odd distortion in adjacent-channel splatter that bleeds into the tuned signal. The fact that the audio circuit/speaker accentuate the treble, make this even more annoying – the “ticks” from adjacent channel splatter are so harsh that you might think the speaker cone is damaged and vibrating.

I’m still waffling on whether to keep this one. It’s a nice little set which is sure to become a collector’s item, and its FM performance really is exemplary. But I kinda view the inclusion of the AM band as its raison d’être and in that regard it could certainly do better.

It’s interesting that you couldn’t reproduce FM overloading or imaging. I have noted images on the FM band and it hasn’t been in a market as congested as that of NYC. It’s only noticeable when listening to stations adjacent to strong signals, however. It’s almost as if the FM filter is a little too wide.

I also agree about analog AM reception.

My HDR-14 review has been delayed due to a very hectic schedule, but I plan to complete it in the next couple of weeks! Thanks again, Mike!

Impressive Transatlantic FM DX: Newfoundland to Northern Ireland on 88.5 MHz

88 MHz Trans-Atlantic signals heard in Ireland

On Sunday the 8th of July 2018, there was a remarkable opening on the VHF bands across the North Atlantic. While there were plenty of strong multi-hop Sporadic-E signals on the 28 MHz and 50 MHz bands, the maximum qusable frequency did reach as high as 88 MHz at one stage.

Paul Logan in Lisnaskea, Fermanagh, Northern Ireland managed to catch CBC radio 1 on 88.5 MHz from Newfoundland, Canada at 22:35 local time (21:35 UTC). It is very rare for openings on Band 2 across the Atlantic and to date, only two people have managed to succeed in hearing North American radio stations.

Jeff discovers that the Sangean WR-2 loses time when playing radio

I wanted you to know that my Sangean WR-2 keeps perfect time when I don’t play the radio, but when I do play the radio I lose 25 minutes; the clock is 25 minutes slow in other words. I’ve read other complaints from Sangean owners, including from those who own the Sangean HDR-18. Some say it has something to do with RDS. Have you heard of this problem? It’s annoying because I have to reset my clock every morning.

Wow–an otherwise excellent radio that prominently features a clock should never have this problem. This problem essentially renders the clock useless.  I’m not sure what would cause this unless it’s incorrectly pulling time data from the RDS function?

Chris’ review of the Sangean WR-7 FM radio and Bluetooth speaker

I recently came across a post on the SWLing Post after I saw Sangean released the WR-7. It recently became available on Amazon and decided to purchase one after seeing your review and Radio Jay Allan’s review.

As I am writing this, I am pleased with the overall quality of this radio. The dark walnut wood is a nice solid build and the light-up dial is a nice touch.

The sound quality is fantastic and beats the pants of my larger iHome “Orb” Bluetooth speaker and sounds a bit better than the Jambox Mini.

I have not done a lot of FM listening yet, but this little radio is pretty sensitive without the wire antenna. It picks up all of the Memphis FM stations with little or no static. With the included wire antenna, I can receive WMAV 90.3 FM in Oxford, MS…about 80 miles away with ease.
The WR-7 is definitely a keeper and will be using it on trips and between rooms in my apartment or outside while sipping on some coffee.

Anywho, I wanted to tell you about my experience with the radio and I have included some pictures of it too.

Thank you for sharing your report, Chris!  You’re right: the Sangean WR-7 is a fine little FM radio and Bluetooth speaker. I’m happy to hear how well it’s serving you and even snagging distant FM stations. Later this year, I’m going on an extended trip and will take the WR-7 with me to provide a nice source of local FM music and WiFi radio while paired with my iPad running TuneIn.

The Brooklyn Pirate Radio Sound Map is live!

I’m happy to announce that my friend and radio producer David Goren has released the Brooklyn Pirate Radio Sound Map: a detailed interactive website exploring the dynamic pirate radio scene in Brooklyn, New York:

“In Brooklyn, when the sun goes down, pirate radio stations fire up their transmitters and take to the air, beaming transgressive, culture-bearing signals into Caribbean, Jewish and Latino neighborhoods. The Brooklyn Pirate Radio Sound Map is an archival home for the sounds of renegade community radio at a crucial turning point in its history.”

The site includes a map and virtual radio pre-loaded with off-air recordings of dozens of pirate radio broadcasters.

Over the past few years, David has put a lot of time and research into this project and I’m pleased to see it come to fruition in such a rich format. You could spend hours exploring the sound map.

Aeronautical RDS: Ivan’s impressive collection of in-flight FM stations

Last week I took an Eton Satellit with me on a flight from Tampa, Florida to Washington DC. The radio is very light, portable and packed with features. I have used an SDR radio before for inlight FM reception where I recorded audio, but this time I decided to only count stations with an RDS lock. With so many signals battling RDS is tricky to catch as every 10 seconds or so one station comes on top of another. The flight was just short of 2 hours and I divided my logs into three 30 minute segments. Not suprisingly looking into the technicalities I noticed RDS is commonly received from stations 50 -100 kW of power and tall towers.

Interestingly signals seem to be stronger a lower altitudes. My theory is that FM broadcast antennas heavily favor gain on the horizontal plane parallel to the terrain and send as little signal as possible out into space. I overlaid my logs onto three maps and also a video:

Impressive Ivan! I’m taking a flight later this month and might even try this with the FM radio built into my Moto G6 smart phone which also includes RDS (although I doubt reception can match that of the Satellit.
